Passing on a double yellow is illegal in Ontario, dangerous as hell but people do it anyway.

I can't count the number of times I've been doing the speed limit or a touch higher and the cager behind is in such blasted hurry that they shoot on around me. I even remember the first time it happened to me riding the scoot. No oncoming traffic, me doing the speed limit and the silly cow driving the cage barely pulls out and passes me as she staddles the double yellow taking half of my lane. As a habit, I pull to the right when I see someone about to pass me and I'm glad I did or she surely would have driven through me.

On the routes I usually go for my weekend rides, there are lots of bikes out and about and most are usually polite about passing. When I see someone coming up fast, I move right over to the fog line and wave them through. Most guys will straddle the center line but i've had a time or two when a whole passle of crotch rockets came thundering through right in my lane. One guy's pressure wave almost sent me to the ditch. Those are the twits that need education.

I don't like to pass slower vehicles unless I am absolutely sure what they are going to do and I will hang back on any double line stretch until I get the dotted line. Saving a few minutes is not worth the risks in my mind. The only time I have broken this rule is with bicycle riders. Coming up on them I will get within 50 feet or so and swing over but close to the yellow and then right back in as I pass. Don't want to scare them.

Ride safe folks.

Cheers,
Spyug.

I want to say I am not looking for a fight.I am new here and I like the site but this post has brought out soooooo many different things.I will say that I have been passed on a double yellow and too many times it's because someone is unhappy with the pace-even though the person(myself) is running at the normal 5 over speed limit I.E. doing 60 in a 55 M.P.H. zone.I do know that NY,if/when ever you cross that double line--No matter what--- you assume ALL responsibility in the event of an accident.I just want to know is it really worth it??I do remember a guy (kid)( when I worked at a motorcycle dealership (Honda&Kawasaki) around 1990 came in and bought a used 1985 Honda Nighthawk S 700 nice clean bike.I had my eye on it but he came in before I could get the coin.He owned the bike 2 nights before he was killed on it.The story is he was on a double solid line and following an older couple and when they hit 45 M.P.H. he would hit his brakes to slow down. The guy on the bike decided well I will just pass him on the right because there is too much oncoming traffic.Well he downs a gear and held it on the pin when Grandpa hit his brakes again only because he caught his Headlight coming like a bullet and tried to pull over......the bike swerved over farther to the shoulder and Grandpa kept comin over and the bike made it to the right front tire of the car.He hit so hard that when the bars and gas tank met his hand was still on the throttle and stayed there while he was thrown over the car into the oncoming traffic lane and was run over there..his parents did not recognize him at the morgue he was that bad...The big problem there was that when people started slamming on thier brakes in the oncoming lane, to miss an accident a 3 year old in his car seat was badly injured because the car they were in was slammed from behind by a dump truck. My point is that if you wanna ride like an idiot.....go man go stupidity is self inflicted, but dont involve anyone else.

WOW,you guys would hate it here in the calif mountains, this is the norm! If your in the way you will get passes on both sides if your not paying attention. These asswipes will pass you even if your going fast (which I do) I even get passed on my zx14 carving a canyon now and then and I am no slouch when it comes to canyon carving. I always like it when the WAD on angeles crest and they are in pain I honk the horn as I go by.

is lane splitting is also legal there?? I don't know if I could handle that(since I've never had to deal with it)

I would like to offer a bit of clarity...... We all have our views about this group or that group, and we poke fun at the hd guys as they try to figure out how to put oil in their bikes, but an observation..... You guys aren't complaining about bikers, or a type of biker, you're complaining about STUPID PEOPLE.:) Stupid people do stupid things, like kneedragging on a beemer their first trip up the dragon. Stupid people ride in between lanes and get creamed missing the car turning left. Stupid people are stupid, and will always be stupid. Leave them be, they don't know they're stupid. Let them breed amongst themselves so we can continue to watch Judge Judy and America's Next Top Model.

You can't fix stupid.

I frequently pass on the double yellow.....QUOTE]

Interestingly, in Hough's book he talks about passing on the double yellow (of which there seems to an ever increasing amount here in Colorado, paritcularly on Hwy 83, a frequent ride for may, including slow putt-putt-putters.....

Hough says something along the lines that speeding is no more or less illegal than crossing the double yellow line...both could land you a ticket....just know the risks and do them safely.....

Double yellow has nothing to do with safe passing on a motorcycle...
The yellow lines usually seem to be designed for underpowered cars, with a really long straight required. Legally they apply to us but in reality, they rarely do. Often a very safe place to pass on a bike has double yellow, quite often a place with no double lines is not safe on a bike.

We can see over little rises, have near instant acceleration, we corner differently than cars.

Sometimes the safest place to pass is a left hairpin corner, where the cars are the slowest, the road is wide and you can see all the way up the next straight. They will certainly be double yellow here if the road has lines at all.

If you know the road, and there are no hidden dangers such as driveways or lanes that split off to the right, go for it.

I would like to know in which states passing on these lines is completely illegal, and which states it's not.

Here you go. PA Law

Here is the relevant reading:
? 3305. Limitations on overtaking on the left.
No vehicle shall be driven to the left side of the center or marked center line of the roadway in
overtaking and passing another vehicle proceeding in the same direction unless the left side is clearly
visible and is free of oncoming traffic for a sufficient distance ahead to permit the overtaking and
passing to be completely made without interfering with the operation of any vehicle approaching from
the opposite direction or any vehicle overtaken. In every event the overtaking vehicle must return to
an authorized lane of travel as soon as practicable and, in the event the passing movement involves the
use of a lane authorized for vehicles approaching from the opposite direction, before coming within
200 feet of any approaching vehicle.

Cross References. Section 3305 is referred to in sections 1535, 1603, 3326, 3327 of this title.
? 3306. Limitations on driving on left side of roadway.
(a) General rule.--No vehicle shall be driven on the left side of the roadway under any of the following conditions:
(1) When approaching or upon the crest of a grade or a curve in the highway where
the driver's view is obstructed within such distance as to create a hazard in the event another
vehicle might approach from the opposite direction.
(2) When approaching within 100 feet of or traversing any intersection or railroad
grade crossing, unless otherwise indicated by official traffic-control devices.
(3) When the view is obstructed upon approaching within 100 feet of any bridge,
viaduct or tunnel.
(b) Application of section.--This section does not apply under the conditions described in section
3301(a)(2),(3),(4) and (5) (relating to driving on right side of roadway).

Cross References. Section 3306 is referred to in sections 1535, 1603, 3326, 3327, 6506 of this
title.
? 3307. No-passing zones.
(a) Establishment and marking.--The department and local authorities may determine those
portions of any highway under their respective jurisdictions where overtaking and passing or driving
on the left side of the roadway would be especially hazardous and shall by appropriate signs or
markings on the roadway indicate the beginning and end of such zones and when the signs or
markings are in place and clearly visible to an ordinarily observant person every driver of a vehicle
shall obey the directions of the signs or markings. Signs shall be placed to indicate the beginning and
end of each no-passing zone.
(b) Compliance by drivers.--Where signs and markings are in place to define a no-passing zone
as set forth in subsection (a), no driver shall at any time drive on the left side of the roadway within
the no-passing zone or on the left side of any pavement striping designed to mark a no-passing zone
throughout its length.
(c) Application of section.--This section does not apply under the conditions described in section
3301(a)(2) and (5) (relating to driving on right side of roadway).
So, basically in PA it is legal when there is no signage specifically stating that it is a "No passing zone".

At one point someone told me passing on double yellow was legal if the person being passed was going under the posted speed by a certain amount, but that apparently was false information as there need be no provision for speed difference under the guidelines. Just so long as there isn't a sign and it's safe to pass, go ahead, at least in PA.

It's sad. I'm guessing you were on Palamar Mt. The locals have a nick name for it. Palamar Raceway. Their was a group that basicly stopped traffic on the freeway the other week over here so they could stunt. Results
6 impounded bikes & 29 tickets

Good!

I've worked hard my entire motorcycling life to earn the respect of non-riders as a sort of "ambassador" for motorcycling and riders. I can't stand it when the "new 1%-ers" continue to make things worse for all of us!!!

Amen to that, tkent02a. I become impatient when the people I ride with will refuse to execute a perfectly safe pass on a double yellow -- just because it's a double yellow. So the group gets split up, needlessly.

So many highway departments paint a double yellow because it's cheaper, more convenient for them, not for the public.

I was always told a double yellow was more of a caution than a illegal. I actually passed an undercover cop on a twisty double yellow on Hwy 7 around Peterborough. I did get a ticket for something else, but not for passing on a double yellow. Never even mentioned anything about the double yellow.

Anyways, car or bike, I pass when it's safe, not when the municipality felt like turning the solid lines off.

I casually passed a white truck on an uphill straightaway with a double yellow in Mt. Rainier National Park. The speed limit was 35 mph, I was doing 65 which seemed lazy and comfortable to me.

However, as I passed the truck, I noticed out of the corner of my eye a logo on the door panel. Nah, its not a park ranger and continued on my way. When I arrived at the Chinook Pass Jct., another ranger was flagging me over. I momentarily considered bolting, but pulled over. The truck I passed pulled in with the head honcho park ranger behind the wheel. He was not pleased and wrote me three tickets in row: Passing on a double yellow, reckless driving, and no insurance. In the end, it was lowered to negligent which I guess I was guilty of.
