  • Returning Visitors

So back in April i gave an old Sienna van to a guy i know for free. Even wrote GIFT in the price area. Took it off my policy and it was removed on May2. Today i get a letter from the traffic camera guys with the picture of the van WITH my old plate on it. Told him to throw the plate away soon as he transfers title and has his own plate. So it was never taken out of my name and whoever was driving didn't have it insured. Tag came back to me so Oklahoma issued me a 190 dollar ticket for operating an uninsured motor vehicle.
So I'm thinking make a report and have the police follow up but how do i get exonerated from this ticket, fine and no points or gigs on my driving record?? Try to do a guy a helping hand and get done dirty. Im less than pleased with him.
 
I'm not an expert on DMV rules around the nation, but typically, when a vehicle is sold, the seller must document such sale as the registered owner. A release of liability is then in effect. At that point, even if the new buyer jacks around with the title and registration, it's not the previous owners problem.
 
I signed and dated the title over to him. As i believe it that releases me from ownership. I didnt use a bill of sale because a title is a legal bill of sale. I dont want to have to resort to police involvement but i sure as hockey sticks am not taking any ticket hit for it either.
 
In New York State, at least, you would accrue zero points or penalties against your license because the photo doesn't prove who was driving at the time of the violation. As the owner, you would be responsible for the fines.

I've received more than one photograph of my ass on the bike in the mail, as well some of my car committing a violation. I've always been more than happy to send a check, as there were no demerits against my license, which would not have been the case if an officer, rather than a camera, had cited me.

However, after a long period of neglecting to pay (years, I believe), they would eventually take action against your license as they have no other recourse. And after enough times with no license, well, then you get a ride in the backseat with the bracelets on.

At least that's how it goes in the Empire State. :hand:

Google suggests that Oklahoma has a form "773 Notice of Transfer of Ownership" document that you are supposed to fill out, and file with the state when a vehicle is sold. It's not strictly mandatory, but it protects you in instances like this.
 
He acknowledged the deal in texts last night.. Told him we need to go to the courthouse to straighten it out. This is his one and only chance to make it right. He fails or tries to prolong it or ghosts me then im calling the cops and filing a report so i can have documentation it wasnt my car at the time. Also my insurance lady is preparing forms from when i had her remove it from my policy. Either way hes gonna get it put on him.
And yes Ed it isnt mandated. All the years ive known him and loaned money and so forth he has always been good so i wasnt worried. Shame on me for trusting.. lesson learned

I never sell a vehicle with a license plate on it.
 
Earl. Plates dont travel or get transferred to another vehicle here. That way the states assured of taking more money. Ilet him use the plate so he could drive it home because ive known him for ears and trusted he would do the right thing. That ship has now sailed. Ill give him till Wednesday to take responsibility or ill get the police involved.

Idk the form number, but yes, that. Costs $10 to file that at the tag agency. That might be enough, don't know. And right, the plates don't go with the vehicles any more, so you should have kept it. I'm meddling a little now, but has he ever helped you? All your examples are the other way 'round.
 
Yes hes helped me many times too. NORMALLY if it was joe blow getting it i WOULD HAE taken the plate. Thats my entire point here guys!!! We have never had a problem for years and i was cutting him some slack by allowing him to drive home with the plate. Obviously me trusting he would do the title and get a plate ( legally ) for it was a huge mistake. Now i gotta deal with this bullcrap to not get points or it put on my driving record. TOTAL crap.
 
Yeah, file that form Chuck, you know, with the date and all that he took it. That might cover it for you.

I left a PikePass thing on one time (that the buyer used), but got out of that somehow. Can't remember the details.
 
Ill go to the tag agency tomorrow and look into it. I dont remember the exact date but it was the end of April. I took it off my policy on May 2nd which was shortly after he took the car.

almost exact same situation that happened to father-in-law years ago when sold a car to a guy. He then was getting parking tickets from multiple city, till bridge charges, and an impound fee.

here in michigan, seller just signs title and is up to buyer to go get title transferred and registered/plated in thier name.
so since my father-in-law’s experience, when I sell a vehical, I also write up a bill of sale for them to sign , but for me to keep, saying they took possession on such and such date and time.
also before they are test driving the vehical, I ask to see thier licence, and then stick it in my pocket haaa haaa (and make a copy of it while they are gone).


but, yah, with personal friend I would be more casual.

Hopefully the records you do have will suffice.

Redman, I'm well versed in the MI vehicle system. I was raised in Turner which is a few miles NW of AuGres. After returning from the Army in 86 i moved to Ferndale and bought my first house in Madison Heights and finally bought another house in Hazel Park.
I called the police Monday morning to explain the situation and get it on record i didn't have the car then and to also have it noted just in case something else happened.. like and accident or whatever.
Officer ran the tag and got the VIN and found that they were both still in my name at the time. He didn't even transfer the title after having the car for 6 weeks!!! So i called him and told him what i learned and told him that " TODAY and today only is your one chance to bring me the tag and we go to the tag agency and get that title transferred or it will be turned over to the state to deal with you":.
About an hour later he calls me that he's on the way to tag agency and he has the plate. He gets to tag agency and he tells me his mom didnt remember where the title is. YES.. They lost the title in just 6 weeks. OH MYGOD!!!
So i filed for a duplicate title and he paid for that fee. I had written a bill of sale dated back to April 25, 2025 when he took the car. So now i have a signed and notarized bill of sale dated April 25, 2025.
Next i got copies of my insurance forms from when i cancelled the insurance as further proof it wasnt in my possession when the camera caught the plate. All this should be enough to not get any points on my record or cause insurance premiums to go up. ALSO he sad he will give me the 190 to pay the ticket. HOWEVER this time he isnt getting the title till i got the 190 in hand. I dont know how it works when a duplicate is issued as far as title serial numbers go. Hopefully they froze the first titles number so it cant be used.
Im counting on him coming up with the fine money. If not im gonna tell him i want the care back. Im old and grumpy and dont have the patience to deal with this kinda crap.

One needs to file a transfer of ownership in Oklahoma. Easily done online.
 
Rob. The replacement title will be in my name. So if he wants to keep the van for his mom hell pay. He for sure will not get this title till he pays up. And the notice will be filed this time.
 
Just curious - how long have you known this guy?

I'm the trusting type, so this could have happened to me.
 
A bill of sale s ALWAYS a good thing to make and keep/

I sold a bike a few years ago, got all the money in cash, kept the plate and the new owner rode away in the evening without a plate on the bike.Gave him a bill of sale that listed his name, address and his driving licence number.

A year later I got a call from the police asking about the bike.....
The bike had just been stopped for speeding.
Cops found the rider had never transferred it into his name, had no insurance.
He was also using a stolen plate, so they seized the bike, then ran a check on the bike's serial number and came up with my name as registered owner..

I had the bill of sale, signed by him as well as me, and gave the cops the details....including his driving licence info.

Cop said thanks, that was all he needed.. Nothing for me to worry about.

That was the end of the story for me.
